"RELEASE AND WAIVER OF LIABILITY – ALL GUESTS MUST READ AND AGREE TO THIS RELEASE AND WAIVER BEFORE PURCHASING YOUR ONLINE TICKETS.

I acknowledge and agree that in consideration of being permitted to participate in the activities [the "Activities"] organized, staged and/or operated by Merry Farms Inc. ["Merry Farms"]:
I hereby release Merry Farms and its directors, officers, employees, sponsors, independent contractors and agents ​[collectively the "Representatives"] ​from any and all liability and hereby waive as against Merry Farms and the Representatives all recourses, proceedings, claims, demands and causes of action of any kind whatsoever in respect of any and all personal injury or property losses which I may suffer arising out of, resulting from or in any way connected with my participation in any and all activities offered or provided by Merry Farms [including and without limitation , tree cutting, wagon rides etc.][collectively the “Activities”], notwithstanding that such injuries or losses may have been caused solely or partly by the negligence or breach of duty of Merry Farms or any of the Representatives.

I hereby acknowledge, confirm and agree that the Activities may be dangerous, exposing participants to many risks and hazards, some of which are inherent in the very nature of a farm itself, others which result from human error or negligence on the part of the persons involved in organizing, staging and or operating Merry Farms. And as a result of these risks and hazards, as a participant, I may suffer serious personal injury, death and or property loss. Notwithstanding, I hereby freely and voluntarily assume all of the aforementioned risks and hazards and confirm that my participation in the Activities shall be entirely at my own risk with full knowledge of the danger I will be exposed to, both foreseeable and unforeseeable. I fully understand that neither Merry Farms nor any of the Representatives assume any responsibility whatsoever for my safety while on the property or during my participation in the Activities.

I have carefully read this Release and Waiver of Liability and fully understand all of its contents and that I freely and voluntarily assume all risks of injury, death and property loss. I furthermore understand that by waving this liability and assuming all risks, I will be forever prevented from making any claims, demands or causes of action against Merry Farms and the Representatives for any loss, injury, or damage arising or resulting from the Activities or any loss or personal injury that I may sustain or incur while on the property or participating in the Activities. I also confirm that I have been given the opportunity and have been encouraged to seek legal advice prior to acknowledging and agreeing to this Release and Waiver and clearly understand that Merry Farms would not permit me to be on the property and to participate in the Activities unless I agreed to this Release and Waiver and the assumption of the aforementioned risks.
